1.           Introduction

ZeroMOUSE Inc and its affiliates, including mousebouncer GmbH, (“ZeroMOUSE” or “we” or “us”) take very seriously the secure, transparent confidential collection and processing of your personal information. Please read this privacy policy carefully as it contains important information on who we are and our information practices, meaning how and why we collect your personal information and how it is processed. It also explains your rights in relation to your personal information and how to contact us or government authorities in the event you have a complaint or request.

We collect, use, and are responsible for certain personal information about you. When we offer goods and services to individuals in the European Economic Area (EEA), we are subject to the EU General Data Protection Regulation (EU GDPR), which applies across the entire European Union (access our). We are responsible as a “controller” of that personal information for the purposes of the GDPR. 2.           Personal Information We Collect

We collect information you input or send us directly, including, for example, your name and contact details (name, title, address, e-mail address, telephone and mobile number).

When you use our website, social media or communicate with us by telephone, e-mail, or other digital communication channel, we collect the following personal information:

  • the basic information you provide us (name, e-mail address, telephone number).
  • the content of your communication and the technical details of the communication itself (with whom you correspond, date and time, etc.).
  • technical information related to the device you are using, such as your IP address, browser type, geographical location and operating system.
  • information about your web surfing habits, such as how long you are on our web pages, which links you click on, which pages you visit and how often you visit a page.
  • any other personal information you provide to us.

When you use our ZeroMOUSE app (“App”), we collect your username, name, email address, user IDs, phone number, photos, App interactions, crash logs, diagnostics, other App performance data, device or other IDs, and other information.

The information we collect automatically is intended to be statistical data, but may include personal information (e.g., “events” of when your cat enters or leaves through the catflap, which our App collects by capturing images may incluse personal information) or we may maintain it or associate it with personal information you have provided us or we collect in other ways.

3.           How Your Personal Information is Collected

We collect personal information from the following categories of sources:

  • You, directly in person, by telephone, text, or email, via our website, social media pages and our App
  • Advertising networks
  • Internet service providers
  • Operating systems and platforms
  • Social networks
  • Publicly accessible sources (e.g., property records)
  • Cookies on our website and in our App

Our App uses third-party service providers that may collect information used to identify you and may track you between apps. You are governed by these third-party service providers. The service providers may include the following:

  • Google Play Services
  • Google Firebase
  • Bugsnag
  • AWS

When you use our App, we collect data and information about App errors (through third-party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the App when utilizing our App, the time and date of your use of the App, and other statistics.

4.           How and Why We Use Your Personal Information

Under data protection laws, we can only use your personal information if we have a proper reason for doing so, for example:

  • To comply with our legal and regulatory obligations.
  • For the performance of our contract with you, your subcontractors, personnel or agents, or to take steps at your request before entering into a contract.
  • For our legitimate interests or those of a third party.
  • Where you have given consent.

A legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interests.

The following list provides what we use (process) your personal information for which we have a legitimate interest:

  • To provide our products and services to our customers and to provide responsive and timely customer service.
  • To improve our App, train our artificial intelligence (AI) based image-recognition system, websites, products or services, or to otherwise understand the use and options for improving our ability to provide better services to our customers.
  • Where you have opted-in, to send you marketing materials about us, our products and services we think you may be interested in, however, we will no longer send you marketing materials after you have opted out and a short period of time for us to process your election to opt out.
  • To prevent and detect fraud against you or ZeroMOUSE.
  • Ensuring business policies are adhered to, for example, policies covering security, internet use, confidentiality of commercially sensitive information.

We do not use your account or contact information for any purpose other than communications and support.

5.           Who We Share your Personal Information With

We routinely share personal information with:

  • Our affiliates, including companies within the ZeroMOUSE group.
  • Service providers we use to help deliver our products and services to you, such as payment service providers, warehouses, and delivery companies.
  • The following other third-party providers:
    • YouTube, when embedded videos are played on the website.
    • Google Ads & Google Analytics, for analyzing and optimizing advertising efforts and measuring user behavior on the website.
    • Meta Pixel, for analyzing and optimizing advertisting on Facebook and Instagram.
  • Other third parties we use to help us run our business, such as website host, Shopify Inc., developers and data processors, including overseas, or external auditors.

We only allow our service providers to handle your personal information if we are satisfied that they take appropriate measures to protect your personal information. We also impose contractual obligations on service providers to ensure they can only use your personal information to provide services to us and to you.

We may disclose and exchange information with law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations. In this event, we will make reasonable efforts to inform you in advance about this disclosure, however, please note that this is not always technically or commercially feasible in certain circumstances, or that legal restrictions may apply.

We may also need to share some personal information with other parties, such as potential buyers of some or all of our business or during a re-structuring. We will typically anonymize information, but this may not always be possible. The recipient of the information will be bound by confidentiality obligations.

Under no circumstances whatsoever will we sell your personal information or make it commercially available to "direct marketing" agencies or similar service providers.

6.           How We Keep Your Personal Information Secure

We have appropriate security measures in place to prevent personal information from being accidentally lost or used or accessed in an unauthorized way. We limit access to your personal information to those who have a genuine business need to access it. Those processing your information on our behalf will only be permitted to do so in an authorized manner and subject to a duty of confidentiality. We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to us. Any transmission of personal information is at your own risk.

7.           Data Transfers to Our Affiliates

Your personal information may be transferred to offices of ZeroMOUSE companies based or operating in countries outside of the country in which you are located. We will use appropriate safeguards to ensure that your personal data is treated securely and in accordance with applicable privacy laws and regulations in connection to such transfers and processing of your personal data in other countries.

8.           How Long Your Personal Information Will be Kept

We will keep your personal information while you have an account with us or while we are providing products and/or services to you. Thereafter, we will keep your personal information for as long as is necessary:

  • To respond to any questions, complaints or claims made by you or on your behalf.
  • To show that we treated you fairly.
  • To keep records required by law.

We will not retain your personal information for longer than necessary for the purposes set out in this policy. Different retention periods apply for different types of personal information.

9.           Children’s Privacy

Our App and website are not intended for anyone under the age of 13. No one under age 13 may provide any personal information to us on the website or in our App. We do not knowingly collect personal information from children under 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you are a parent or guardian and you are aware that your child has provided us with personal information, please immediately contact us.

We use “cookies” on this website: small information files that are automatically saved on the hard drive of your computer. We use cookies to optimize website functionality, analyze the performance, and provide personalized experience to you. Some cookies are essential to make the website operate and function correctly.
